Agreement to Terms
By accessing and using the services provided by EColorSigns.com (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.
Description of Services
EColorSigns.com provides custom signage design, manufacturing, and related products including:
- Custom sign design and consultation
- LED and neon sign manufacturing
- Dimensional letters and channel letter signs
- Tradeshow displays and booth graphics
- Vehicle wraps and graphics
- Digital signage solutions
- Emergency sign repair and maintenance
- Delivery and project management services
Ordering and Payment Terms
Quotes and Estimates
All quotes are estimates and may be subject to change based on final project specifications, site conditions, or material costs. Quotes are valid for 30 days unless otherwise specified.
Payment Schedule
- 50% deposit required upon order confirmation
- Progress payments may be required for large projects
- Final payment due upon project completion
- Emergency services require payment upon completion
Last Payment
Late payment fees of 1.5% per month may be applied to overdue balances. Continued non-payment may result in suspension of services and legal action for collection.
Design and Intellectual Property
Custom Designs
Custom designs created by our team remain our intellectual property until full payment is received. Upon full payment, you receive a license to use the design for the specified project.
Client-Provided Materials
You warrant that any logos, text, images, or other materials you provide do not infringe on third-party rights and that you have the right to use them for signage purposes.
Portfolio Use
We reserve the right to photograph completed projects and use them for marketing and portfolio purposes unless specifically prohibited in writing.
Delivery and Site Requirements
Client responsibilities for delivery projects include:
- Providing safe and clear access to delivery sites
- Obtaining all necessary permits and approvals
- Ensuring utilities are marked before excavation
- Providing adequate electrical connections when required
- Notifying us of any site hazards or restrictions
Warranties and Guarantees
Product Warranty
We provide a one-year warranty on materials and workmanship. LED components carry a manufacturer’s warranty as specified by the manufacturer.
Warranty Exclusions
Warranties do not cover damage from:
- Acts of nature (storms, earthquakes, floods)
- Vandalism or intentional damage
- Normal wear and tear
- Modifications by others
- Failure to follow maintenance recommendations
Limitation of Liability
To the maximum extent permitted by law, EColorSigns.com’s liability is limited to the amount paid for the specific service that gave rise to the claim. We are not liable for:
- Indirect, incidental, or consequential damages
- Lost profits or business opportunities
- Delays caused by weather, permit issues, or force majeure events
- Damage to existing structures during delivery
Cancellation and Refund Policy
Order Cancellation
Orders may be cancelled within 24 hours of confirmation for a full refund. After production begins, cancellation fees may apply based on work completed.
Emergency Services
Emergency service calls are non-refundable once our technician is dispatched to your location.
Force Majeure
We are not liable for delays or inability to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, weather conditions, labor disputes, government actions, or supply chain disruptions.
Dispute Resolution
Any disputes arising from these Terms or our services will be resolved through:
- Good faith negotiation between the parties
- Mediation if negotiation fails
- Binding arbitration as a final resort
Governing Law
These Terms are governed by the laws of the state where our business is located, without regard to conflict of law principles.
Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of our services constitutes acceptance of revised Terms.
